Day 63: Can this get any more absurd?
Today my Contracts professor out did himself. He presented an article about a couple who couldn't conceive. The husband is infertile so they contract with the husband next door to *manually* impregnate the wife for $2500. Apparently the husbands looked somewhat alike and the other had 3 beautiful children. Turns out that after 72 "tries" the wife is still not pregnant. That is when we find out that the neighbor husband is also infertile and the kids aren't his. Now we discuss breach of contract, remedy, and what risk was taken in light of the mistake that was made (i.e. the wife wouldn't get pregnant by dude next door v. dude next door couldn't impregnate the wife). With that comes the quote of the day comparing this case to other cases on the same subject of mistake: "There is a market for the cow. There is a market for the Stradivarius. There is a market for the stone. What is the market for prostituting your wife?" Have a good weekend folks!
