Incredibly happy to start my Friday morning with Contracts ... well while he wasn't being peevish that we neglected to answer his challenge question adequately anyway. I inadvertently ended up defending the "sinister minister" who sold bibles door to door for $350 (but that isn't what made him sinister). His suspect behavior came in the form of using the bible sales as a segue into scoping out antiques in the houses. He bought them for cheap and sold at a substantial profit. Guilty of fraud? I say thee nay! The people he fleeces ... errr ... ummmm ... buys from could easily find out what their crap is worth. But even better than the sinister minister case file, we had the haunted house case again! This time the question was not about a duty to disclose the ghosts, but whether the contract could be rescinded considering the buyers only wanted a regular house which was described as vacant in the sale. Just so you know, yes they can get out of the contract for several reasons, not the least of which being that the poltergeists counted as occupants. HAHAHAHAHAHAHA
