Day 40: Paranormal activity

Today's Property reading was Stambovsky v. Ackley. If you are unaware, the case is about a guy who bought a house, purportedly haunted, unbeknownst to him. The case is to explore the seller's duty to disclose and analyze the duty of the purchaser to find out about the property.  Cite to Shakespeare's Hamlet Act I, Scene IV [Ghost] . Cite to Ghostbusters cause "who ya gonna call".  Decide that because there is no way for a buyer to protect against hauntings, he can be let out of the contract.  And so "the notion that a haunting is a condition which can and should be ascertained upon reasonable inspection of the premises is a hobgoblin which should be exorcised from the body of legal precedent and laid quietly to rest." I SO love law school!
