Continued the discussion on damages (i.e. how much the plaintiff can hope to get through a suit) in Torts yesterday. Talked at length about the injured party's duty to mitigate damages by seeking medical attention and following given advice, up to and including surgery. Then a voice in the back of the room inquires: "what happens if the person dies on the operating table?" In response came the quote of the day! "A dead body is worth a lot less than a live person with an injury."
